Why is establishing paternity important?

When an unmarried couple has a baby, they must take an extra legal step to establish paternity to legally declare the biological father as the legal father. Paternity is required before pursuing other family law-related actions, such as child custody and child support.

Establishing paternity offers many advantages for your child, including

  • Your child can have access to both parents’ medical histories
  • Your child can legally qualify for benefits through his or her father
  • Your child can receive child support from his or her father
  • Your child can have a chance to develop a healthy bond with his or her father

Paternity can be established through a paternity affidavit or by going to court. If there is no disagreement about the paternity of a child, then both parents can sign the paternity affidavit. Signing this document means both parents agree to the rights and responsibilities of caring for the child. If there is a dispute regarding a child’s paternity, then you may request a DNA test through the court.
